On 23 April 2024 Dr Alan Littler spoke at the the Casino Operations Summit in Amsterdam. As part of the Gaming in Holland mini-conference he discussed the District Court Oost Brabant judgement of 29 February 2024, in which it was held that several land-based monopolies are in breach of EU law.
In his contribution he discussed the content of the Court’s judgement and reflected on its implications for the land based gambling sector in the Netherlands, which are potentially far-reaching. Depending on the future decision of the Council of State (the Netherlands Gambling Authority appealed the judgement, and an injunction was granted to suspend the judgement effect until the Council’s decision on the merits), the decision poses a real threat for the existing land-based monopolies for sports betting, scratch cards and lotto games. If upheld it will have a dramatic impact on the Dutch gambling landscape.
